ACAS & EMPLOYMENT TRIBUNAL (ET)

You have 3 months minus 1 day from the last event that you complain of to submit a claim to the Employment Tribunal. However, if you are considering submitting a claim, you must obtain an ACAS early conciliation certificate first. You must therefore submit an early conciliation request within 3 months minus 1 day from the last event that you complain of. Submitting an ACAS conciliation request stops the 3-month clock, which starts going again upon your receipt of the certificate.

Calculating the 3-month limitation period might be tricky, so please book a consultation with me to discuss this point, however in general terms you have 3 months minus 1 day from:

​

  • The day of dismissal

  • The last discriminatory act

  • The last underpayment etc

​

To send your case to the Tribunal;

 

Currently a life span of a Tribunal case takes between 6 and 12 months – depending how complicated your matter is, discrimination considerably lengthens this process.
